Prohibited Acts in Voting in Person14 The following acts are prohibited in voting in person: 1. Speak with anyone while accomplishing his/her ballot, other than as herein provided; 3. Intentionally tear, deface, or erase any printing on the ballot or put thereon any distinguishing mark; 4. The SBEI acts through its Chairperson and decides by majority vote questions which may arise in the course of the performance of its duties. As a general rule, all resolutions of the SBEI should carry the attestation of the Chairperson.3 The SBEI is required to accomplish in two (2) copies the Minutes of Voting and record the act required therein as they occur or become available during voting. The copies of the Minutes of Voting are sealed inside separate envelopes. The first copu$C0ch0:#`0A#00B =@)v$Bd0RPj xB xB xy is to be submitted to the Comelec while the second copy is to be deposited inside the ballot box.4 III. Preliminaries to Manual and Automated Counting of Ballots Cast in Person5 The preliminaries to manual and automated counting of ballots cast in person refer to the step-by-step procedures to be followed by the SBRCGs and the SBEIs before starting the actual counting of ballots cast. These step-by-step procedures are embodied in Comelec Resolution No. 6466. IV. Procedures for Accomplished BalXB =T)$CxChxE#hxH#xx0B P=,). A. Applications for Registration Upon receipt of the applications, the Chairperson of the RERB shall immediately set the applications for hearing in accordance with the schedule provided by Comelec Resolution No. 7447. The notice of hearing on the application should be posted at the office of the COAV and in its website at least one (1) week before the date of the hearing. Furthermore, all political parties and other parties concerned should be notified of the pending applications for registration through a weekly updated publication in the websites of the Comelec and the DFA. The RERB shall determine whether the applicant possesses all the qualifications and none of the disqualifications for registration. If the applicant meets all the qualifications and none of the disqualifications for registration, the RERB shall approve the application. If not, the RERB shall disapprove the application. In cases where there are questions on the application of a registrant, any interested party may file a verified objection to the application on or before the date set for the hearing of the said application. If an objection is filed, the Chairperson of the RERB shall immediately notify the applicant or his/her authorized representative of the said objection personally or by registered mail, together with copies of the objection and the documents submitted in support thereof, if any. The applicant or his/her authorized representative shall, within five (5) days from receipt of the copy of the objection, file by registered mail an answer that clearly states his/her defenses and is duly sworn before any officer authorized to administer oath. For this purpose, the date postmarked in the envelope containing the answer shall be considered as the date of the filing, provided that (for the 2007 elections) answers to objections to applications filed from August 1 to 31, 2006, shall be received by the RERB not later than October 19, 2006. Due to these restrictions and conditions, few Filipino immigrants or permanent residents abroad applied for registration as overseas absentee voters. Dual citizens were likewise discouraged from registering as overseas absentee voters because they were required to establish prior residence in the Philippines before they were allowed to vote. 5. Absence of passports and other identification documents. In some cases, the passports of overseas Filipino workers were kept by their employers. Without their passports in their possession, many overseas Filipino workers were discouraged from registering as overseas absentee voters.31 6. Undocumented Workers feared identification and exposure. The extended voting period for seafarers (60 days, in contract to only 30 days for land based voters) did not appear to be effective in attracting them into the electoral process. Only 2,547 seafarers registered as overseas absentee voters in sixty-five (65) Posts worldwide. Thirty-eight (38) of these Posts had less than ten (10) seafarer voters each registered in their rolls. Out of this figure, ten (10) of these Posts had only one registered seafarer voter each. 9. Restrictions imposed by host countries on political activities. Some countries in the Middle East prohibited election related activities outside of the Posts. As a result, the Philippines found it difficult to negotiate for the establishment of registration and voting centers outside of the Posts. A similar restriction existed on the publication of information on overseas absentee voting in some countries. As an alternative, concerned Filipinos conducted their information drives in restaurants, churches, bus and taxi stands.34 In China, the Post was not allowed to publish in the newspapers the notice of registration and election for overseas absentee voting. 10. After all, an application to acquire foreign citizenship is a mere declaration of intention until approved. The individual is entitled to change his/her mind while his/her application is pending. His/her application for foreign citizenship might not even be approved at all. In fact, the foregoing negative condition imposed on the right to vote of Filipino immigrants and permanent residents abroad is an anachronism to the right to vote of Filipinos with dual citizenship including those who reacquired Filipino citizenship under R. A. No. 9225 otherwise known as The Citizenship Reacquisition and Retention Act of 2003. Filipinos with dual citizenship may register and vote as overseas absentee voters provided that they satisfy the residence requirements under Section 5(d) of R. A. No. 9189. If Filipinos with dual citizenship are allowed to vote, why should the Filipino immigrants and permanent residents abroad who remain to be Filipino citizens be deprived of their right to vote by mere reason of their application for the acquisition of a foreign citizenship? Since they still possess the citizenship qualification to vote, why should they be disqualified from exercising their right of suffrage? Another disincentive from registering as overseas absentee voters is the requirement for Filipino immigrants or permanent residents abroad to resume actual, physical and perorigin, property, birth or other status. Distinctions between those who are entitled to citizenship by birth and those who acquire it by naturalization may raise questions of compatibility with Article 25. Upon approval of an application for certification as a registered voter, the RERB shall: (a) direct the Election Officer (EO) concerned to make an annotation in the Computerized Voters List (CVL) of the city/municipality and in the applicants VRR that the said applicant has been registered as an Overseas Absentee VV~3&-I+' A">C  a newspaper of general circulation, or in local Filipino newspapers of wide circulation, in countries where there are at least 5,000 Filipinos.3 Both R. A. No. 9189 and Comelec Resolution No. 7447 acknowledge the increasing popularity of information technologies and require that such notices to be likewise posted in the official websites of the Comelec and the DFA. III. The Registration Period The registration period for overseas absentee voting is determined by the Comelec.4 For the May 2007 elections, the registration/certification period is set for eleven (11) months, between the period October 1, 2005 to August 31, 2006. During this time, the Posts shall accept applications for registration or certification on designated hours, five (5) days of each week.5 IV. Mode of Registration A registrant is required to appear personally when registering for overseas absentee voting.6 The applicants biometric data (personal information, photograph, signature, etc.) are captured using data capturing machines (Doter or will be voting as an Overseas Absentee Voter; and (b) include the names of the applicants with approved applications in the NROAV and in the CLOAV. IX. Petition for Exclusion of Voters17 A petition for exclusion of voters is a judicial remedy available to an interested party to question the registration or certification of an unqualified overseas absentee voter. Any interested party may file a verified petition for the exclusion from the NROAV of a registered or certified Overseas Absentee VoteCMs) during registration. Submission to live capture of biometrics may be done at the applicants convenient time but within the registration/certification period. Otherwise, the application shall be deemed as not filed.7 V. Places of Registration Where can one register as an overseas absentee voter? Under Section 6 of R. A. No. 9189, the application for registration or certification shall be filed before the Election Registration Board (ERB) of the city or municipality where the applicant was domicilr not later than December 15, 2006 (for the 2007 elections), as follows: 1. For applications for registration or certification previously approved by the local ERB in connection with the May 10, 2004 national elections, with the proper Municipal or Metropolitan Trial Court (MTC); and 2. For applications for registration or certification approved by the RERB for the 2007 elections, with the MTC-Manila. The court shall decide the petition within fifteen (15) days after its filing on the basis of the documents submitted in connection therewith and should the court fail to render a decision within the prescribed period, the ruling of the RERB shall be considered affirmed with finality. X. Petition for Inclusion of Voters18 If an application for registration is denied by the RERB, the applicant or his/her authorized representative may, within a period of five (5) days from receipt of the notice of disapproval of his/her application for registration, file a motion for reconsideration before the RERB which shall decide the same within five (5) days after its filing on the basis of documents submitted in connection therewith. If the motion for reconsideration is given due course by the RERB, the name of the movant shall be included in the NROAV, unless otherwise there be an order from a court of competent jurisdiction for the exclusion of his/her name. In this case, the applicant may seek judicial remedy. In this case, the applicant may seek further judicial remedy. Petitions for inclusion of voters for applications disapproved in connection with the May 10, 2004 elections may no longer be filed. XI. The National Registry of Overseas Absentee Voters (NROAV) PART II THE 2004 OVERSEAS ABSENTEE VOTE Part One presented an abridged version of R. A. No. 9189, outlining the procedures and mechanisms for its implementation. Part Two now looks at theLP51  % ( F(GDIC_FGDICRp@"Arial Narrow0dlfdgd-0  {0K0f0lfdgl؎ d0(T0 0f 00 {P;b0Xl8p0Xlq{܀(dv actual experience in the 2004 general elections when the law was first put to test. Chapter One : OAV Preparations I. Timetable The government had very little time to prepare for the first implementation of the overseas absentee voting law in the May 2004 elections. The substantive debates and obstacles that delayed its passage by Congress subsequently left very little time to set in motion the mechanisms that would be needed to implement the law. Despite the fact that the President endorsed overseas absentee voting to Congress as a priority measure since 2001, Congress was able to pass R. A. No. 9189 only in February 2003, or barely five months before the start of the overseas absentee voting registration period in August 2003. As a consequence, the appropriation by Congress and release of funds for overseas absentee voting came quite late. Comelec rushed to draft the implementing rules and regulations on R. A. No. 9189 which was promulgated on May 14, 2003, or three (3) months before the start of the registration period.1 More specific guidelines and regulations were issued by Comelec after the issuance of the implementing rules and regulations of R. A. No. 9189. On top of these, a petition questioning the constitutionality of some of the key provisions of R. A. No. 9189 was resolved by the Supreme Court only on July 10, 2003, or a mere twenty (20) days before the start of the registration period.2 II. Comelec-DFA Preparatory Activities Time was short but the Comelec and the DFA, the governmed immediately prior to his/her departure from the Philippines. If the registrant is already based abroad, the application for registration may be filed with the Comelec representatives at the Philippine embassies, consulates and other foreign service establishments that have jurisdiction over the locality where the prospective overseas voter temporarily resides.8 For the May 2004 elections, the Comelec allowed the registration of overseas absentee voters to be filed before the following: 1. Representative of the Comelec at the Posts having consular jurisdiction over the locality where the applicants vessel is docked during the registration period, for seafarers already abroad; 3. ERB of the city/municipality/district where the applicant is domiciled prior to his/her departure from the Philippines, for qualified Filipinos who will bent agencies primarily responsible for the overseas absentee voting exercise, faced up to the challenges of the implementation of R. A. No. 9189 for the first time. The proceeding section describes the preparatory activities by the Comelec and the DFA for the 2004 elections. The Comelec, through its Committee on Overseas Absentee Voting chaired by Commssioner Florentino A. Tuason, Jr., oversaw and supervised the implementation of R. A. No. 9189. The DFA on the other hand, created the DFA Overseas Absentee Voting Secretariat (DFA-OAVS) by virtue of DFA Department Order No. 06-03 which was issued by then Foreign Secretary Blas Ople o March 3, 2003. The DFA-OAVS was put in charge of directing, coordinating and overseeing the DFAs participation in the implementation of R. A. No. 9189. It was likewise tasked to coordinate with Comelec and other government agencies in undertaking or supporting election activities or operations. The DFA-OAVS is chaired by DFA Undersecretary Rafael E. Seguis. During the 2004 elece abroad on election day; and 4. The Committee on Overseas Absentee Voting (COAV), for qualified seafarers who are still in the Philippines during the registration period but who will be abroad during the voting period.9 As an offshoot of the Comelecs assessment of the implementation of R. A. The main preparatory activities that were initiated by the DFA-OAVS and the Comelec-COAV can be classified into four (4) major types. First was the establishment of the database of the existing Filipino organizations that would serve as a reference for setting up the citizens support network for the elections. Third were training activities that were aimed to capacitate government personnel and volunteer groups assisting in the exercise. Fourth and equally critical were information dissemination activities. Below is the list of the preparatory activities:3 1. Development of databases (environmental mapping database, Filipino Association database and hotline assistance service); 2. Development of the DFA Internal Guidelines on overseas absentee voting that provided step-by-step guidelines on the conduct of overseas absentee voting registration and other activities that were disseminated to all Posts; 3. Development by the DFA of eleven (11) flowcharts of procedures which provided a systematic description of the step-by-step process of registration, preliminaries to voting, voting, post-voting procedures, preliminaries to counting, counting of votes and canvassing of election returns; 4. During the preparation stage between the period May 14, 2003nt Election Registration Board to take over the functions of the ERBs on overseas absentee voting. In addition, the Comelec limited the filing of applications for registration or certification as an overseas absentee voter for the 2007 elections before the following: 1. No government agency or accredited private organization is allowed to prepare, print, distribute or post in websites any information material without the prior approval of the Comelec.3 II. Campaigning Abroad Political campaigns abroad by candidates and political parties courting the votes of overseas absentee voters are governed by applicable laws of the PFGDICRp@"Arial Narrow0dlfdgd-0 {0K0f0lfdg}d0(T0 0f@t 00 t{P;b0Xl8p0Xlq{܀(dv%    T|GA4FAL{zkfyaXpXQaMF\KCVGANB>LA/*9/(@1*D4.E5-F5-I70J60M50V>4^A6eA8hD7jF:lL@iKA^A9bC;gD>oLCsNBuOArM@{VI|WE~YFaNfRjRcPjYkZiWgUk[odtiyk|n}oxjtipg{q~rtw{~zvxwkdt`ViUN[IDVHAQD>I@95:7455145202/,.+02/02/.2/NSRhilippines and of the host countries. The Omnibus Election Code, as amended, and other elections laws not in conflict with R. A. No. 9189 remains in force and has suppletory application to R. A. No. 9189.4 Thus, the prohibition on premature campaigning, prohibited forms of election propaganda, campaign expenditures and election offenses apply with equal force to overseas absentee voting. The Philippine foreign service corps plays a crucial role in the conduct of the overseas absentee voting. They take part in all aspects of the overseas voting process from registration, casting of votes, counting and canvassing of votes. The law recognizes that political neutrality of the foreign service corps is the key to the successful conduct of overseas absentee voting. Thus, in order to shield the foreign service corps from partisan political activities, they are governed by the following rules of conduct during the campaign and election period: 1. Members of the foreign service corps may attend public social/civil/religious affairs where candidates may also be present, provided, that these officers and employees do not take part in the solicitation of votes and do not express public support for candidates. 4. While nothing in the R. A. No. 9189 shall be deemed to prohibit free discussion regarding politics or candidates for public office, members of the foreign service corps cannot publicly endorse any candidate or political party, nor take part in activities involving such public endorsement. 5. No partisan political activity shall be allowed within the premises of the embassy, consulate and other foreign service establishment. 6. Government-sponsored or permitted information dissemination activities shall be strictly non-partisan and cannot be conducted where a candidate is present. 7. A member of the foreign service corps cannot be asked to directly organize any meeting in behalf of a party or candidate, or assist in organizing or act as liaison in organizing any such meeting. The prohibition shall apply to all meetings social, civic, religious meetings where a candidate will be present.5 III. Printing and Transmittal of Ballots, Voting Instructions, Election Forms and Paraphernalia The Comelec, through its Committee on Printing, causes the printing of ballots, voting instructions, election forms. Security markings are used in printing ballots.
